INFORMED CONSENT & RELEASE OF LIABILITY for the 5th Annual Mission Marathon Fundraising Event. Agreement of Participant: I, the undersigned, understand and agree that at all times, it is my sole responsibility to look out for my physical and mental well-being while participating by running or walking during this event and that I am at all times free to leave or to choose not to participate in the Mission Marathon Event. I further agree that if I choose to participate, then my participation is with the knowledge and understanding that I could suffer physical harm and that my participation is at my own risk, which I willingly assume. As a condition of participation, I agree on behalf of myself, my heirs, executors, and assignees, to release the Mission Marathon organizers and the Center of The Golden One® (“Center”), the 501(c)(3) nonprofit corporation which is the beneficiary of the proceeds of this event, and the event volunteers from all claims or liability arising from my participation including any claims that may be determined to result from any negligence on the part of the Center or any of its staff or volunteers. I further promise and agree that I will not commence any action against the organizers and the Center or event volunteers for any reason whatsoever. I represent that I am of sound mind and body, of legal age, and that I have carefully read the above notice and agreement and I sign below in agreement and of my own free will. This Agreement covers my participation in the Annual Mission Marathon event. BY CLICKING MY ACCEPTANCE OF THIS AGREEMENT I REPRESENT THAT I AM OF SOUND MIND AND BODY, OF LEGAL AGE AND THAT I HAVE CAREFULLY READ THE ABOVE NOTICE AND AGREEMENT AND I SIGN MY NAME OF MY OWN FREE WILL. THIS AGREEMENT COVERS MY PARTICIPATION IN THE ANNUAL MISSION MARATHON FUNDRAISING EVENT. MY ELECTRONIC SIGNATURE SHALL HAVE THE SAME FORCE AND EFFECT AS IF I SIGNED IN PERSON AND SHALL BE BINDING ON MY HIERS, EXECUTOR, PERSONAL REPRESENTATIVES AND ASSIGNS.
